These Terms of Use ("Terms") govern your access to and use of the Vibes4Tribes mobile application (the "Service"), operated by Vibes 4 Tribes, LLC ("we," "us," or "our"). Please read these Terms carefully.
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. Using Our Service
a. Eligibility: You must be at least 13 years of age (or the minimum legal age in your country to use our services) to create an account and use the Service.
b. Your Account: You are responsible for any activity that occurs in your account. Keep your login credentials secure. You must not create an account using false information or on behalf of someone else.
c. Acceptable Use: Your use of the Service must comply with all applicable laws and regulations. You agree not to:
Post content that is illegal, fraudulent, harassing, hateful, or discriminatory.
Post content that infringes on any third party's intellectual property rights.
Use the Service to send spam or unsolicited commercial messages.
Impersonate any person or entity.
Engage in any activity that could harm, disable, or overburden the Service.
Post content that includes nudity, graphic violence, or promotes dangerous organizations.
Use any robot, spider, scraper, or other automated means to access the Service for any purpose, including data mining, scraping content, or otherwise bypassing our security measures.
Use any content from the Service, including User Content, for the purpose of training any artificial intelligence (AI) or machine learning models.
d. Prohibited Use – No Coordination of Illegal Activity: You agree that you will not use the App, or any of its features, to:
1. Plan, coordinate, or conspire in the commission of any crime, including but not limited to violent offenses, fraud, theft, or any other illegal conduct.
2. Organize, promote, or facilitate gatherings that are intended to incite hatred, discrimination, or violence against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
2. Your Content
a. Your Responsibility: You retain ownership of and responsibility for all content you create and post ("User Content"). You warrant that you have all necessary rights to your User Content.
b. License Grant to Vibes4Tribes: You grant Vibes4Tribes a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating, providing, and improving the Service.
c. License Grant to Other Users: You grant other users a license to access your User Content as permitted by the Service's functionality (e.g., within a Tribe). This includes the right for potential premium subscribers to download photos via Gallery Exports.
3. Our Intellectual Property
The Service and its original content, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, design, and the "look and feel" of the app) are owned by Vibes 4 Tribes, LLC, its licensors, or other providers of such material. These "Vibes4Tribes Materials" are protected by United States and international copyright, trademark, patent, and other intellectual property laws. Except as explicitly authorized by us, you agree not to sell, license, copy, modify, or otherwise make unauthorized use of the Vibes4Tribes Materials.
4. Feedback
You are under no obligation to provide us with ideas, suggestions, or feedback ("Feedback"). If you do submit Feedback, you hereby grant Vibes 4 Tribes, LLC an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose, including to improve the Service and create other products and services.
5. Mobile App Terms (Apple & Google)
If you access the Service via our mobile app, you acknowledge that these Terms are between you and us only, and not with Apple Inc. (Apple) or Google, Inc. (Google). Apple and Google are not responsible for the App or its content. Apple and Google have no obligation to furnish any maintenance or support services for the App. You acknowledge that Apple and Google are third-party beneficiaries of these Terms, and upon your acceptance, they will have the right to enforce these Terms against you as a third-party beneficiary.
6. Community & Safety
Vibes4Tribes is a community built on trust and respect.
a. Tribe Permissions: You are responsible for the tribes you create. As a creator, you can set your tribe to "Open" or "Closed (By Approval)" to manage how new members join. You agree not to approve members who violate these Terms.
b. Blocking & Reporting: To maintain a safe environment, you have the ability to block and report other users.
Blocking: You can block any user at any time from their profile. When you block a user, they will not be able to find your profile, see your vibes, or add you to tribes.
Reporting: You can report a user for violating our policies. When you submit a report, the reported user will also be automatically blocked for your safety. We reserve the right to review these reports and take appropriate action, including suspending or terminating the user's account.
c. User Interactions: You are solely responsible for your interactions with other users. Vibes4Tribes is a platform to facilitate spontaneous hangouts. We are not responsible for what happens during those hangouts. Use good judgment and take appropriate safety precautions.
7. Premium Services and Subscriptions
a. Paid Features: Certain features, such as those in the "Vibes+ Ultra" tier (e.g., exclusive filters, gallery exports, advanced reports), may require a subscription ("Premium Services").
b. Billing and Payment: All payments are processed through your app store provider (e.g., Apple App Store, Google Play Store) and are subject to their terms.
c. Subscriptions: Subscriptions automatically renew unless you cancel them through your app store account settings before the end of the billing period.
d. No Refunds: All payments are non-refundable except as required by law.
8. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if you violate these Terms. You can delete your account at any time through the "Settings" screen.
Please note: Even after your account is terminated, your User Content, including messages and photos you have shared in chats and galleries, may remain visible to the other users with whom they were shared.
9. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. We do not guarantee that the Service will be safe, secure, or error-free, or that it will function without disruptions or delays.
10. Limitation of Liability & Release
To the maximum extent permitted by law, you release and discharge Vibes 4 Tribes, LLC and its affiliates, officers, directors, employees, agents, and licensors from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way related to your use of the app or services.
You understand that Vibes 4 Tribes, LLC is not responsible for any damages or losses resulting from your use of the app, including but not limited to, data loss, financial loss, or any other type of damage or loss.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.
12. Dispute Resolution, Arbitration, and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.
a. Good Faith Negotiation: You and Vibes 4 Tribes, LLC agree to negotiate in good faith to resolve any dispute between us. b. Binding Arbitration: If we cannot resolve a dispute, you and we agree to resolve any claim arising from these Terms or the Service through final and binding individual arbitration. c. Class Action Waiver: YOU AND VIBES 4 TRIBES, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. d. Time Limitation: YOU AGREE THAT ANY CAUSE OF ACTION BROUGHT BY YOU ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
13. Waiver of Jury Trial
YOU AND VIBES 4 TRIBES, LLC HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT EITHER OF YOU MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION ARISING OUT OF, UNDER, OR IN CONNECTION WITH THESE TERMS.
14. Copyright Policy (DMCA)
We respect the intellectual property rights of others. If you believe that anything on our Service infringes upon a copyright which you own or control, you may file a notification of such infringement by emailing:
Your notice must comply with the requirements of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512(c)(3).
15. Changes to These Terms
We may modify these Terms from time to time. We will provide you with notice of any material changes (e.g., via an in-app notification). Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
